Terms of Use Agreement
Acceptance of Terms
Welcome to Internationale Rekrutierung. By accessing or using our website, mobile application, or services (collectively, the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Platform.
1. Definitions
- “Platform” refers to the Internationale Rekrutierung website, mobile application, and all related services.
- “User” refers to any individual or entity accessing or using the Platform.
- “Candidate” refers to a User seeking employment opportunities.
- “Employer” refers to a User seeking to recruit candidates.
- “Content” refers to any information, text, graphics, resumes, job postings, or other materials uploaded to the Platform.
2. Eligibility and Account Registration
- You must be at least 18 years old to use our Platform.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- You must notify us immediately of any unauthorized use of your account.
3. User Responsibilities
For All Users:
- You will not use the Platform for any illegal or unauthorized purpose.
- You will not post false, misleading, or fraudulent information.
- You will not harass, abuse, or harm another person.
- You will not interfere with or disrupt the Platform’s functionality.
- You will not attempt to access another user’s account without authorization.
- You will not use automated systems (bots, scrapers) to access the Platform without our permission.
For Candidates:
- You represent that all information in your profile, resume, and applications is truthful and accurate.
- You are responsible for ensuring you have the legal right to work in the location of any job you apply for.
- You understand that applying for a job does not guarantee an interview or employment.
For Employers:
- You represent that you have the authority to recruit on behalf of the company listed.
- Job postings must be for legitimate employment opportunities.
- You will comply with all applicable employment laws, including non-discrimination laws.
- You will maintain the confidentiality of candidate information and use it solely for recruitment purposes.
- You will not post jobs for pyramid schemes, “pay-to-work” opportunities, or any business model that requires candidates to pay fees.
4. Job Postings and Applications
- We are a venue connecting Candidates and Employers. We are not a party to any employment relationship.
- We do not guarantee the accuracy, quality, or legality of job postings or candidate profiles.
- We are not responsible for the hiring decisions, employment terms, or working conditions offered by Employers.
- Employers are solely responsible for the content of their job postings and their recruitment process.
5. Content Ownership and License
- Your Content: You retain ownership of the Content you submit to the Platform. By submitting Content, you grant Internationale Rekrutierung a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that Content for the purpose of operating and promoting the Platform.
- Our Content: All Platform design, text, graphics, logos, and software are owned by or licensed to Internationale Rekrutierung and are protected by intellectual property laws. You may not copy, modify, or distribute our Content without express written permission.
6. Prohibited Content
You agree not to post Content that:
- Is discriminatory based on race, religion, gender, age, disability, or any other protected characteristic.
- Contains confidential information of a third party.
- Is sexually explicit, violent, or threatening.
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary right.
- Contains viruses or any other malicious code.
7. Platform Availability and Modifications
- We strive to maintain Platform availability but do not guarantee uninterrupted or error-free service.
- We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time.
- We may update these Terms periodically. Continued use after changes constitutes acceptance of the new Terms.
8. Fees and Payments (if applicable)
- Certain premium services may require payment.
- All fees are stated in the currency specified and are non-refundable unless otherwise stated.
- You agree to provide accurate billing information and authorize us to charge the provided payment method.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERNATIONALE REKRUTIERUNG AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US IN THE PAST SIX MONTHS, OR €100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Internationale Rekrutierung and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your use of the Platform.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Your Content.
12. Termination
- We may suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users.
- You may terminate your account at any time by contacting us or using account deletion tools.
13. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.
- For consumers residing in the EU, you may also be entitled to submit a complaint to the online dispute resolution platform of the European Commission.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
